Our Director, Colin Liew, has authored an analysis on the Singapore High Court’s decision in NextEra Energy Global Holdings BV and another v Kingdom of Spain [2026] SGHC 43, published by LexisNexis Arbitration expert.
The court dismissed Spain’s attempt to set aside the registration of an ICSID award, confirming that Spain could not rely on state immunity to resist enforcement of an Energy Charter Treaty award. The judgment confirmed the application of both the Submission Exception (s 4) and Arbitration Exception (s 11) under the State Immunity Act 1979 and rejected Spain’s Intra-EU Objection.
The ruling further strengthens Singapore’s reputation as a reliable enforcement forum for investor-state awards.
