In The Kingdom of Spain v Infrastructure Services Luxembourg S.À.R.L. [2026] UKSC 9, the UK Supreme Court has confirmed that by becoming party to the ICSID Convention, a contracting state waives its immunity from the adjudicative jurisdiction of the courts of other contracting states for the purposes of recognising and enforcing ICSID awards. A respondent state cannot invoke the State Immunity Act 1978 (the SIA 1978) to block registration of an ICSID award in the English courts.
