In NextEra Energy Global Holdings BV v Kingdom of Spain [2026] SGHC 43, the General Division of the High Court has held that by acceding to the ICSID Convention, a contracting state waives its immunity from the adjudicative jurisdiction of the courts of other contracting states for the purposes of recognising and enforcing ICSID awards. A respondent state cannot invoke the State Immunity Act 1979 (the SIA) to block registration of an ICSID award in the Singapore courts.
