Rohit Bhattacharya

Rohit is a Foreign Counsel with the firm and specialises in commercial disputes across a wide range of sectors, focusing on shareholder disputes, construction, infrastructure & energy disputes, and enforcement & debt recovery.

His experience includes international arbitrations under SIAC Rules, ICC Rules, DIAC Rules, and UNCITRAL Rules; international mediations under the SIMC Rules; and international litigation in various jurisdictions.

Rohit has acted, including as lead counsel, in several international arbitrations and in litigations before courts in DIFC and India. These include emergency arbitrations, obtaining early dismissals, and seeking worldwide freezing orders. He has also acted as instructing counsel in cross border disputes before courts in the Cayman Islands, Indonesia, Switzerland, Turkey, the United Kingdom, and the United Arab Emirates. Prior to joining Providence Law Asia, Rohit was involved in setting up a Foreign Law Practice of an international disputes boutique in Singapore, where he advised and acted for clients in disputes pertaining to construction, infrastructure & energy, shipping & trade, enforcement & debt recovery, and sports & entertainment. He has also worked in the United Arab Emirates and India.

Rohit graduated from Hidayatullah National Law University, Raipur with a B.A. LL.B. (Hons). He represented his University in various moot court competitions, including the Oxford IP Moot in Oxford, England and the Willem C. Vis International Commercial Arbitration Moot in Vienna, Austria. Rohit is fluent in English and Bengali, and conversant in Hindi.

Professional Experience

  • Acted for two Indian companies in a $1.1 billion SIAC arbitration under a joint venture agreement for the construction of a thermal power plant in India, against a Korean Sovereign Company.
  • Acted for an Indian and a Singaporean company in a $265 million arbitration concerning the termination of a contract for the conversion of a mobile offshore drilling unit to a mobile offshore production unit, against an Indian state-owned enterprise.
  • Acted for an Indian company in a $100 million tri-partite SIAC arbitration concerning the termination of a contract for the construction of a bio-ethanol plant in the Philippines, against an Australian employer and a Filipino co-contractor.
  • Acted for a Qatari HNI in a $100 million DIAC arbitration under a settlement agreement for relinquishing his shares in a multinational oil and gas enterprise against his Indian joint venture partner and a Cayman Islands group company.
  • Acted for a private-equity backed master franchisee in seven UNCITRAL arbitrations against the former franchisees of a multinational quick service restaurant chain.
  • Acted for a private-equity backed Indian company in an SIAC arbitration concerning the wrongful termination of two agreements for the design and construction of a data centre, against the affiliate of an American multinational corporation and technology company.
  • Represented a petrochemical project management company in an ICC arbitration against a Chinese State-owned construction engineering conglomerate, arising out of the non-payment of success fees under two consultancy agreements for the provision of contractual, claims, and commercial consultancy services in relation to oil facilities projects.
  • Acted as lead counsel for a Turkish company in an ICC arbitration against an Indian company under an agreement for the sale of agricultural raw materials.
  • Advised an Indian company in an ICC arbitration against a Turkish employer relating to the construction of a circulating fluidised bed combustion boiler in Istanbul, Turkey.
  • Advised Indian and Singaporean promoters of a sports broadcasting company in an SIAC arbitration against an American multinational media company.
  • Advised a leading global litigation funder for its investment in a portfolio of disputes concerning several construction projects across India.
  • Acted for an Indian and a Singaporean company in proceedings before the Bombay High Court concerning interim reliefs and the invocation of bank guarantees under a contract for the conversion of a mobile offshore drilling unit to a mobile offshore production unit.
  • Acted for a Qatari HNI in a pre-action disclosure application and tracing claim before the DIFC Courts against three DIFC-based venture capital firms.
  • Acted for an English medical repatriation company in proceedings before the DIFC Courts against a Burundian individual’s estate and his South African agent relating to an anti-suit injunction.
  • Acted for a former employee of a private equity fund in proceedings before the DIFC Courts against the former employer, in relation to the non-payment of carried interest dues.
  • Acted for two UAE companies and their promoter before the DIFC Courts in a dispute for the non-payment of rent and the encashment of rental cheques under a shareholders’ agreement and a tenancy agreement.
  • Acted for a Qatari HNI before the DIFC Courts in proceedings relating to the enforcement of a provisional arbitral award against his Indian joint venture partner.
  • Acted for an Indian company before the DIFC Courts in proceedings relating to the enforcement of an MCIA award and obtaining freezing orders in aid of enforcement, against a Liberian company.
  • Acted for a UAE company before the DIFC Courts in proceedings relating to the enforcement of an LCIA award, against one of the world’s largest Japanese automobile companies.
  • Acted for a UAE company before the DIFC Courts in proceedings relating to the enforcement of an ICDR-IFTA award, against a Californian media company.
  • Advised a Rwandan company in proceedings relating to the enforcement of a KIAC award against an African State.
  • Advised an Indian company on the enforcement of an arbitral award in various jurisdictions including the United Kingdom, Switzerland, and Canada, against an African State and a State-owned entity.
